Terms and Conditions

These Terms and Conditions govern the relationship between Travel Fun with Kamala and the undersigned ("Client") regarding the booking and arrangement of travel services. By engaging the services of the Travel Agent, the Client agrees to the following terms and conditions:


1. Role of Travel Agent

The Travel Agent acts as an independent contractor and intermediary between the Client and suppliers (such as airlines, hotels, tour operators, cruise lines, car rental companies, and other travel-related service providers). The Travel Agent facilitates the booking process but is not responsible for the actual provision of travel services. All services are subject to the terms and conditions of the respective suppliers.


2. Booking Confirmation

Once the Client agrees to a travel arrangement, the Travel Agent will confirm the booking with the supplier. A booking is not confirmed until the Client receives written confirmation from the Travel Agent, which may include a booking reference number, invoice and/or itinerary. It is the Client's responsibility to review the confirmation carefully and notify the Travel Agent immediately of any discrepancies. We encourage you to be especially attentive to the legal spelling of your name as it appears on your required documents and your date of birth. If these are wrong, fees may be incurred to change and/or the supplier may deny you the right to travel with no compensation. 


3. Payments and Fees

The total cost of travel, including deposits and final payments, will be provided to the Client in the confirmation. Payment terms vary depending on the supplier and will be communicated in advance. The Client must adhere to all payment deadlines to avoid cancellation or penalties.


4. Cancellations and Changes

a. Client-Initiated Cancellations: Any cancellation requests must be made in writing to the Travel Agent. Refunds or credits, if applicable, are subject to the terms and conditions of the suppliers. 

b. Supplier-Initiated Changes: Suppliers may make changes to travel arrangements, including flights, accommodations and itineraries. The Travel Agent will make reasonable efforts to notify the Client of any changes, but the Client agrees that the Travel Agent is not responsible for any such changes or resulting inconveniences.


5. Travel Insurance

The Travel Agent strongly recommends that the Client purchase travel insurance to protect against unforeseen events, including trip cancellations, medical emergencies and lost luggage. The Client acknowledges that travel insurance is not included in the cost of travel unless otherwise stated. It is the Client's responsibility to evaluate their needs and purchase an appropriate insurance policy.


6. Passports, Visas, and Health Requirements

The Client is responsible for ensuring that they meet all passport, visa and health requirements for their travel destinations. The Travel Agent may provide guidance but assumes no responsibility for obtaining the required documents or meeting entry requirements. Failure to comply with such requirements may result in denial of travel or other penalties, for which the Travel Agent will not be liable.


7. Liability

The Travel Agent does not own, operate, or control any of the services provided by suppliers and, therefore, assumes no liability for any delays, cancellations, accidents, or injuries caused by such suppliers. The Client agrees to hold the Travel Agent harmless from any claims arising from third-party services.


8. Force Majeure

The Travel Agent shall not be held liable for any delays or inability to provide services due to circumstances beyond their control, including but not limited to natural disasters, government actions, labor strikes, pandemics, or any other events of force majeure.


9. Governing Law

This Agreement shall be governed by the laws of the United States, and any disputes arising under this Agreement shall be resolved exclusively in the courts.


10. Amendments

These Terms and Conditions may be amended or modified by the Travel Agent at any time, and such changes shall be effective upon written notice to the Client.
